MÛŞ - 22 people were sentenced for attending the funeral of Mîr Perwer, a singer who was murdered in Paris. A young man named Davut Aktaş was sentenced to 3 years and 8 months for wearing a "mask" to protect himself from teat gas.
Twelve of 22 people who were detained for attending the funeral of singer Mîr Perwer (Mehmet Şirin Aydın), who was murdered in the attack against Ahmet Kaya Kurdish Cultural Centre on 23 December 2022 in Paris, were arrested. 12 people who were arrested on charges of "resisting to prevent the execution of duty", "Law No. 2911" and "damaging public property" were released at the first hearing held on 20 July 2023.
SENTENCED ON 3 SEPARATE CHARGES
22 people were sentenced at the final hearing held at Muş 3rd Criminal Court of First Instance. The court sentenced 21 people to 2 years 3 months and 15 days each for "disobeying an assembly and demonstration by holding stones". The same people were sentenced to 2 years and 6 months for "resisting to prevent the execution of duty" and 2 years and 1 month for "damaging public property". A young man named Davut Aktaş was sentenced to high penalties on separate counts.
Davut Aktaş, who participated in the funeral ceremony, was sentenced to 3 years and 8 months on the charge of "armed participants in a meeting and march / those who cover their faces for the purpose of concealment", 2 years and 3 months on Article 32 of Law No 2911, 6 years and 6 months on the charge of resisting to prevent the execution of duty, and 2 years and 6 months on the charge of damaging public property. Evaluating the sentences, Davut Aktaş stated that they wore masks to protect themselves from pepper spray and water cannons used by the police and that this was also considered a crime.
The court decided to continue the ban on leaving the country for 22 citizens.
WHAT HAPPENED?
On 12 June 2023, police raided many houses in the morning hours in the centre and districts of Mûş. Detained 22 people were held at the Provincial Security Directorate for 4 days. The reason for their detention was their attendance to the funeral of the artist Mîr Perwer (Mehmet Şirin Aydın), who was murdered in the armed attack against the Ahmet Kaya Kurdish Cultural Centre in Paris on 23 December 2022.
12 of the 22 people arrested were released at the first court hearing. It was reported that the prosecutor insulted the young people who attended the hearings, and that the same prosecutor also insulted the body of Perwer.
The youth had filed a criminal complaint against the prosecutor's insults.
